1. To Enter: No purchase necessary. To submit an entry, visit www.turntospartan.com, (the “Web­site”), between 12:00:01 a.m. EST on October 4, 2009 and 11:59:59 p.m. EST on December 26, 2009, follow the on-screen instructions and enter all of the requested information. You must register on the Website (unless you are already registered) before being eligible to submit an entry; registration is free. In case of dispute, entries and votes will be declared made by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet Access Provider, online service provider or other organization (e.g., business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. 2. Entries. Your entry must be a recipes that contains a list of all ingredients, all preparation directions and include a photograph of the finished recipe that also incorporates the Spartan Brand packaging utilized during the recipe preparation. Photographs must be submitted in one of the following formats .gif, .jpg, .png, and .tiff. The recommended resolution is a minimum of 400 x 400 pixel dimension and a maximum file size of 10MG. Entries will be posted on website to which they were entered and by entering this Contest you consent to the posting of your entry/recipe on that website. You can submit one entry recipe for each category: Appetizers, Entrees, and Desserts. By submitting an entry recipe, you represent and warrant that: (i) your entry is of your utilization of your own Spartan Brand product, is your original creation and does not infringe on any other person’s or entity’s rights including, but not limited to, copyright, trademark and rights of publicity or privacy; and (ii) you have obtained permission from any people (or person) pictured in your entry to enter this Contest. Any entry that includes content the Sponsor deems inappropriate, indecent or obscene, or abusive as determined by the Sponsor in its sole discretion, will not be eligible. Sponsor and participating Spartan Stores are not responsible for lost, stolen, or misdirected entries. Recipes will be checked for accuracy, and incomplete and illegible entries will be disqualified. All entry recipes become the property of Sponsor and will not be returned.
3. Winner Selection: On or about January 29, 2010, a group of judges will review all recipes submitted and select twenty (20) prizewinners from all entries submitted. Entries will be judged on ease of preparation, originality, and best use of the Spartan Brand product. Odds of winning will depend on the number of eligible entries received for this contest. All decisions of the judges and sponsor are final as to all contest-related matters.
4. Prizes: One (1) Grand Prize winner will receive ten (10) $100.00 Spartan stores gift certificates with a total retail value of $1,000.00. One (1) First Prize winner will receive five (5) $100.00 Spartan stores gift certificates with a total retail value of $500.00. Two (2) Second Prize winners will each receive two (2) $100.00 Spartan stores gift certificates with a total retail value of $200.00. Two (2) Third Prize winners will each receive one (1) $100.00 Spartan stores gift certificate with a total retail value of $100.00. Six (6) Forth Prize winners will each receive one (1) $50.00 Spartan stores gift certificate with a total retail value of $50.00. Eight (8) Fifth Prize winners will each receive one (1) $25.00 Spartan stores gift certificate with a total retail value of $25.00. Spartan stores gift certificates can be used to purchase any products at any participating Spartan Store except alcohol, tobacco, lottery tickets, postage stamps, Ticketmaster and any other items restricted by law. All prizes will be awarded.
5. General Conditions: Sponsor will have all rights to copy, edit, broadcast, publish and use, in whole or in part, any entry in any manner without further compensation (except where prohibited by law). Winners will be notified by mail, email and/or phone within 30 days of determination of winners at the address or phone number or e-mail on the entry. If a winner cannot be located or does not respond to claim the prize within 14 days after notification, the prize will be awarded to an alternate winner. All federal, state and local taxes are the sole responsibility of the winners. Winners may be required to sign a Prize Winner’s Affidavit of Eligibility and Release Form within 14 days of notification. In the event of noncompliance, an alternate winner will be selected. By acceptance of prize, winners agree without limitation to the use of their name, photograph and/or likeness for publicity purposes without any additional compensation, except where prohibited by law. No substitution of prizes permitted, except that the Sponsor reserves the right to substitute a prize of equal or greater value in the event any prize cannot be awarded as stated. Prizes are transferable at the sole discretion of the Sponsor. Entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to this Contest. By participating in this Contest, entrants agree that Sponsor, participating Spartan Stores, and their respective representatives, agencies, affiliates, subsidiaries, directors, officers and employees have no liability whatsoever for any injuries, losses or damages of any kind resulting from the acceptance, possession, use or misuse of any prize or technical, hardware, software or telephone failures of any kind, cost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by Sponsor, users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit an entrant’s ability to participate in the Contest. Sponsor may prohibit an entrant from participating in Contest or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception or other unfair playing practices (including the use of automated quick entry and voting programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor’s representatives. Sponsor reserves the right to terminate or amend this Contest, in whole or in part, at any time without notice, if any factor including without limitation virus, bugs, or non-authorized human intervention, interferes with its conduct as contemplated by these official rules. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
6. Representations: All entries must be original work, never been previously published or submitted in any competition, and must not infringe on any third party rights. Modification of any existing work does not qualify as an original. By acceptance of prize, winners agree without limitation to the use of their name, photograph and/or likeness for publicity purposes without any additional compensation, except where prohibited by law. Submission of an entry grants sponsor and its agents and affiliates the right in perpetuity to reproduce, publish, use, edit, adapt and/or modify such entry in any way, in any and all media, without limitation and without compensation to contestant. Submission of entry further constitutes contestants’ consent without further compensation to use the entry for advertising or publicity purposes where not prohibited by law. Contestants waive any and all claims relating to ownership of their submission. Acceptance of the prize shall constitute the winners’ consent to the use of their name and/or likeness for advertising without additional compensation.
7. Eligibility: Must be a resident of Michigan, Indiana or Ohio, 18 years or older at the time of entry, have had Internet access prior to the first date of the Contest and be registered with one or more of the Websites to win. Employees of Sponsor, participating Spartan Stores and their licensed dealers, agents and affiliates, and employees’ immediate families are not eligible to win. Immediate family members include relatives living at the same address as an employee. Void where prohibited, taxed, licensed, or restricted by law.
